PRIVACY NOTICE: AVANT PARTNER PORTAL

 

1. DATA CONTROLLERS

 

Avant Tecno Oy together with its importers and resellers (hereinafter referred to jointly as the "Controllers") act as joint controllers in regard to the processing of personal data carried out in the Avant Partner Portal (the "Portal").

The Controllers are jointly responsible for the processing of your personal data and its compliance with the law, as well as for exercising your data subject rights, in accordance with an agreement entered into between the Controllers.

 

2. GENERAL

 

This privacy notice, drafted pursuant to the General Data Protection Regulation (EU 2016/679), describes how the Controllers process your personal data in the Portal.

 

3. CONTACT INFORMATION

 

Questions and requests relating to the processing of personal data carried out in the Portal may be sent by email to gdpr@avanttecno.com.

The questions and/or requests are then directed to the relevant Controller.

 

4. PURPOSES AND LEGAL BASES FOR PROCESSING

 

Personal data is processed for the following purposes:

  • managing customer relationships
  • managing the life cycle of products, such as compact multi-functional loaders or work equipment, auxiliary attachments and spare parts for such loaders
  • managing warranties
  • direct marketing based on customer relationships

The legal basis, pursuant to the GDPR, for the processing of personal data is:

  • in regard to consumer clients, the performance of a contract
  • in regard to business clients, the Controllers’ legitimate interest (the operation and development of business activities)

Compiled and statistical datasets may be derived from personal data stored in the Portal. However, it is impossible to identify individual persons from such datasets.

Personal data is not used for automated decision making or profiling.

 

5. CATEGORIES OF PERSONAL DATA

 

The following categories of personal data are processed in the Portal:

  • name
  • contact information
  • organization possibly represented
  • client segment
  • the purchase, maintenance and warranty histories of products
  • information contained in possible product-related safety deviation notices

Personal data is collected from you or the organization you represent in connection with a transaction, as well as from your importer and/or reseller.

Providing personal data is not required by law or contract. However, providing certain personal data is required in order for the Controllers to provide their products and services.

 

6. DISCLOSURE OF PERSONAL DATA

 

The Controllers may disclose personal data to such service providers, i.e. data processors, who process personal data on behalf of the Controllers and pursuant to their instructions. An example of such a data processor is the party providing the Portal’s platform. The Controllers require that data processors comply with applicable data protection legislation and take appropriate measures to protect personal data. Data processors are not entitled to use personal data disclosed by the Controllers for their own purposes.

 

7. TRANSFERS OF PERSONAL DATA OUTSIDE THE EU OR THE EUROPEAN ECONOMIC AREA

 

Some of the aforementioned data processors or their sub-processors are located outside of the EU or the EEA. In such cases, the Controllers ensure the level of data protection by ensuring that the European Commission has adopted a decision concerning the level of data protection offered by the target country (an adequacy decision), or, for example, by requiring that the data processor accepts the Standard Contractual Clauses approved by the European Commission to be part of the data processing agreement between the Controller and the processer.

 

8. STORAGE OF PERSONAL DATA

 

Personal data is stored only as long as and to the extent that it is necessary for the purposes defined in Section 4.

In general, personal data is stored for the duration of the customer relationship. If the Controllers become aware of changes relating to the contact persons of business customers, for example, the data will be updated accordingly.

 

9. RIGHTS OF THE DATA SUBJECT

 

9.1 General

 

You may exercise your rights described herein this section 9 via email using the address gdpr@avanttecno.com.

You will be informed of the actions taken based on your request generally within one month of receiving the request. You will also be notified if your request will not, for any reason, be fulfilled.

Exercising these rights is generally free of charge.

Please note that in order to fulfil your rights, additional information may be requested so that you may be identified in a sufficient manner.

 

9.2 Right of Access

 

You may ask for confirmation on whether your personal data is being processed. You may also request information concerning your personal data and access it.

 

9.3 Right to Rectification

 

You may request that inaccurate, incorrect or incomplete personal data concerning you is rectified or supplemented.

 

9.4 Right to Erasure

 

You may request the erasure of your personal data for example if said personal data is no longer required for the purposes for which it was gathered.

Please note that your personal data may not in all situations be erased, for example if there is a legal obligation or another lawful basis to store the data.

 

9.5 Right to Restrict Processing

 

You may request the restriction of the processing of your personal data in certain situations defined in data protection legislation, for example if you have contested the accuracy of your personal data and the accuracy is being reviewed.

The restriction of processing means that the personal data may only be processed on very limited grounds defined in data protection legislation.

 

9.6 Right to Object

 

You may object the processing of your personal data if the processing is based on legitimate interest. In such cases, personal data will no longer be processed, unless the Controllers can demonstrate that there are compelling legitimate grounds for the processing which override your rights.

 

9.7 Right to Data Portability

 

You may, under certain conditions set out in data protection legislation, request that the Controllers provide you with such personal data concerning yourself which you have provided to the Controllers and transfer this personal data to another controller.

 

9.8 Right to Lodge a Complaint to a Supervisory Authority

 

If, in your opinion, your personal data is not being processed appropriately or your rights are not fulfilled sufficiently, you may lodge a complaint to a national supervisory authority, especially in the European Union member state of your permanent residence or place of work, or where the alleged violation of data protection legislation has taken place.

 

10. AMENDMENTS TO THE PRIVACY NOTICE

 

This privacy notice will be amended upon changes in the processing of personal data and/or applicable legislation.

We recommend that you familiarize yourself with the contents of this privacy notice regularly. You will be notified of significant changes in the processing of personal data.
