PRIVACY NOTICE: AVANT PARTNER PORTAL AND AVANT CONNECT APPLICATION
1. DATA CONTROLLERS
Avant Tecno Oy and its importers and dealers (together the "Data Controllers") act as joint controllers with respect to the processing of personal data carried out in the Avant Partner Portal and Avant Connect services ("Applications").
The Data Controllers are jointly responsible for the processing of your personal data and its lawfulness as well as for ensuring the exercise of your rights, in accordance with the agreement concluded between the Data Controllers.
2. GENERAL
This notice, prepared in accordance with the EU General Data Protection Regulation (2016/679), explains how the Data Controllers process your personal data in the Applications.
3. CONTACT
Inquiries related to the processing of personal data carried out in the Applications may be submitted by email to gdpr@avanttecno.com.
The inquiries will be directed to the appropriate Data Controller through the aforementioned address.
4. PURPOSE AND LEGAL BASIS OF PROCESSING
Personal data is processed for the following purposes:
- maintenance of the customer relationship
- lifecycle management of a product, attachment, and spare part
- warranty administration
- direct marketing based on the customer relationship
The legal basis for the processing of personal data under the EU General Data Protection Regulation is:
- for consumer customers: performance of a contract
- for contact persons of business customers: the legitimate interest of the Data Controllers (conducting and promoting business operations)
Composite and statistical datasets may be created from data stored in the Applications. Individual persons cannot be identified from such datasets.
Personal data is not used for automated decision-making or profiling.
5. CATEGORIES OF PERSONAL DATA
The following categories of personal data are processed in the Applications:
- Name
- Contact details
- Represented organisation, if applicable
- Customer segment
- Purchase, maintenance, and warranty history of products
- Information contained in any possible safety deviation reports related to products
Data is obtained directly from you or from the organisation you represent during the purchase transaction, as well as from your importer and/or dealer.
The provision of personal data is not mandatory under law or contract. However, providing personal data is a prerequisite for offering the products and services of the Data Controllers.
6. RECIPIENTS OF PERSONAL DATA
The Data Controllers may disclose personal data to service providers acting as data processors who process personal data on behalf of and in accordance with the instructions of the Data Controllers. Such data processor may be, for example, the service provider providing the platform for the Applications. The Data Controllers require data processors to comply with data protection legislation and to apply appropriate measures to protect personal data. Data processors are not permitted to use disclosed personal data for their own purposes.
7. TRANSFER OF PERSONAL DATA OUTSIDE THE EU/EEA
Some data processors used by the Data Controllers, or their subcontractors, are positioned outside the EU or EEA. In such cases, the Data Controllers ensure the level of personal data protection by verifying that the European Commission has issued an adequacy decision for the country in question, or, for example, by requiring the data processor to accept the European Commission’s standard contractual clauses as part of the agreement between the Data Controller and the data processor.
8. RETENTION OF PERSONAL DATA
Personal data is retained only for as long as and to the extent necessary for the purposes listed in section 4 above.
Principally, personal data is retained for the duration of the customer relationship and/or as long as the person is registered in the Avant Connect application. If the Data Controllers become aware of changes regarding contact persons of business customers, the information will be updated accordingly.
9. RIGHTS OF DATA SUBJECTS
9.1. General
You may exercise the rights described in this section 9 by contacting gdpr@avanttecno.com.
You will be notified of any actions taken based on your request, in principle no later than one month after receipt of the request. You will also be informed if your request will not be fulfilled for some reason.
The exercise of your rights is, in principle, free of charge.
Please note that additional information may be required from you in order to verify your identity sufficiently for the exercise of your rights.
9.2. Right of Access to the Personal Data
You may request confirmation as to whether personal data concerning you is being processed. You may also request information with regard to the personal data collected about you and access such data.
9.3. Right to Rectification
You may request the rectification or supplementation of your personal data if the data is inaccurate, incorrect, or incomplete.
9.4. Right to Erasure
You may request the erasure of your personal data, for example if the data is no longer necessary for the purposes for which it was collected.
Please note that it might not be possible to erase your personal data in all situations if its retention is required by legal obligation, or if another lawful basis exists for its retention.
9.5. Right to Restriction of Processing
You may request the restriction of the processing of your personal data in certain situations defined in data protection legislation, such as when you have contested the accuracy of your personal data, in which case processing will be restricted for the duration of the verification of accuracy.
Restriction of processing means that personal data may be processed only on very limited, legally defined grounds.
9.6. Right to Object
You may object to the processing of your personal data if the processing is based on legitimate interest. In such a case, your personal data will no longer be processed unless the Data Controllers can demonstrate compelling legitimate grounds for the processing that override your rights.
9.7. Right to Data Portability
Under certain conditions specified in data protection legislation, you may request the Data Controllers to provide you with personal data concerning you that you have provided to them, and to transfer such data to another controller.
9.8. Right to Lodge a Complaint with a Supervisory Authority
If you believe that your personal data is not being processed appropriately or your rights are not being adequately fulfilled, you may lodge a complaint with a national supervisory authority, in particular in the EU Member State of your habitual residence or place of work, or where the alleged breach of the General Data Protection Regulation occurred.
10. AMENDMENTS TO THE PRIVACY NOTICE
This privacy notice shall be updated when necessary, due to changes in the processing of personal data and/or applicable legislation.
We recommend reviewing the contents of the privacy notice regularly. You will be notified of significant changes related to the processing of personal data.
